Boba and Bill had to sign this agreement. This document was used often by Comander Gatti during the whole trip to the Mountains ofd the Moon.. This agreement made in duplicate by The Gatti-Hallicrafters Expeditions (Vermont) Inc, a corporation organised under the laws of the State of Vermont and having its principal place of business at Derby in the county of Orleans, State of Vermont, hereinafter called the "Corporation", and Robert E. Leo, of 1003 B Street, San Mateo, in the county of San Mateo and the State of California, hereinafter called the "Employee", whitnesseth, (1) Whereas said Corporation is about to undertake an expedition into East and Central Africa for an estimated duration of eight to twelve months, and (2) Whereas by reason of the itinerary of said expedition, and the difficulties of supplies, and inability to obtain skilled and trusted employees as said expedition progresses, and (3) Whereas it is essential to the success of said expedition that the members thereof understand the nature and requirements of the undertaking: Now therefore (4) Said Corporation agrees to employ the Employee and the Employee agrees to enter into the employment of the Corporation in the capacity of Amateur Radio Operator for the duration of said expedition, subject to the conditions and provisions hereafter written. (5) The Corporation agrees to pay the said Employee as entire compensation for his services the sum of Twenty-Five Dollars ($25.00) per week, to begin on the date when the said expedition shall leave new York City and end on the date of the said expedition's return to New York City, subject however to the conditions and provisions hereinafter written. (6) The Corporation reserves hereby for the leader of said expedition the right to terminate this contract at any time by giving the Employee a two weeks notice thereof in writing. (7) It is hereby mutually agreed by the parties hereto that in the event the said Employee is discharged as aforesaid that the said Corporation will provide at its expense transportation of said Employee to the seacoast and will furnish the said Employee his passage from said seacoast to New York City. (8) It is further mutually agreed by the parties hereto that in the event that the Employee resigns or abandons the expedition before its return to New York City the salary of said Employee shall cease, and the said Corporation shall thereupon pay to the said Employee upon the Employee's request such salary as is then his due but deducting from it the total amount required for the Employee's return passage to the seacoast and the to New York City, and said Corporation's liability and responsibility for his return shall thereupon be terminated. (9) Said Corporation hereby agrees, except as aforesaid, to pay the board and transportation of the said Employee, beginning on the date of his departure from New York City and ending when the said expedition returns to said city. (10) The Corporation agrees to supply the Employee with certain changes of clothing suitable for the climate and conditions encountered on such expedition, and further agrees to pay for the Employee's passport and visas required while employed on said expedition, and further agrees to provide the Employee, while so employed in Africa, with shelter either in a tent or a trailer, such accommodations to be shared by not more than four men; and further agrees to provide him with the services of what native boys the leader of such expedition shall judge adequate. (11) It is mutually agreed by the parties hereto that the said expedition covers parts of unsettled and uncivilized equatorial Africa and that said Employee assumes the risks incident to the employment, both as to disease and under hazards. (12) However the Corporation agrees to furnish the Employee while employed on said expedition necessary medical and / or hospital care in case of sickness or accident to the best of its ability, considering the time and place where same occurs. It is however mutually agreed by the parties hereto that the said Corporation or its agents, including the leader, shall not be liable to said Employee or his heirs, executors or administrators for any damages or claims for any cause whatsoever arising out of any illness, injury or loss of life of the said Employee. (13) The said Employee in consideration of the promises and agreements aforesaid hereby agrees to give to the said Corporation his exclusive services for the duration of said expedition from the date of his sailing from New York until the date of his return to New York and to devote himself to the best of his capacity and ability to the particular work for which he was employed, and to such other duties, during such expedition, as may be assigned him by the said leader, and further agrees to perform said services without any limitation as to time and nature of the work so assigned; and further agrees to maintain in good condition all equipment and stores entrusted to his care; and further agrees to conform with all regulations adopted for such expedition and all special instructions given him by the leader of such expedition. (14) The said Employee in consideration as aforesaid agrees to furnish at his expense his own liquors and tobaccos. (15) The said Employee in consideration as aforesaid hereby agrees that, in the event he participates in any radio, television and transcription program and/or motion and still pictures for commercial advertising or other purposes as directed by the leader of said expedition, he will execute without remuneration any releases required from him for the free use of his voice, name and picture. (16) The Employee in consideration of the promises and agreements aforesaid agrees that all photographs, movies and any other objects of photography taken during the expedition with or without the assistance and/or participation of the said Employee are to be the sole and exclusive property of the Corporation, and the said Employee agrees not to retain or in any way dispose of any copy, print, enlargement or other reproduction without first obtaining the consent in writing of the leader of the expedition; and further agrees that he will not write, broadcast, lecture or give interviews to the press concerning the expedition or anything connected with it directly or indirectly until two years after the return of said expedition; and further agrees not to remain in Africa at the end of his services with said expedition nor to stop anywhere during his return trip to American without written authorisation by the leader of the expedition. (17) The Employee in consideration as aforesaid agrees that, while he is employed on said expedition, he will at all times abide by the laws and regulations of the countries through which the expedition passes; and further agrees to maintain a deferent and polite attitude toward the leader and all other members of the expedition; and further agrees to abide by the regulations established by the leader of the expedition while in camp, whereby the privacy and freedom of both the leader and the members of said expedition may be preserved for the best interests of said expedition. (18) It is mutually agreed by the parties hereto that the departure of the expedition will undertake is tentatively fixed for November 28th, 1947, and the Corporation will undertake to give the Employee at least fifteen days prior notice of said departure. But the said Corporation shall not be liable to the Employee in damage for the postponement of the date of departure, even though such notice has been given, or in the event that the said expedition is cancelled, or in the event that the Corporation considers it necessary for any reason whatsoever to cancel the participation of the Employee to the expedition. (19) It is hereby mutually agreed and made a part of the consideration of this agreement that all still and moving pictures, radio, television, transcription and all other work performed by the members of said expedition may be publicized by said Corporation, under the direction of the leader of the expedition, and any individual credit given therein to the members of the expedition shall be determined by the leader of the expedition. (20) It is mutually agreed by the parties hereto and made a part of the consideration of this agreement that this contract shall be construed under the laws of the United States of America and that no action of any description shall be brought by either party hereto except within said United States, and both parties hereby expressly waive the right to bring any action elsewhere. (21) In witness whereof the parties hereto have subscribed their names and affixed their seals this 14th day of (September) October 1947.
